downloadDish Network’s Hopper DVR, which allows users to completely skip commercials, has been vehemently (and understandably) opposed by Hollywood studios. Dish has won a major victory in its latest legal battle over the device.

The United States Court of Appeals for the Ninth Circuit has denied Fox’s petition to rehear a rejection from last summer regarding Fox’s efforts to prevent Dish subscribers from using the Hopper DVR.

R. Stanton Dodge, Dish EVP and general counsel, was suitably pleased with the court’s decision:

“With this decision, the court continues to reject Fox’s efforts to deny our customers access to PrimeTime Anytime and AutoHop . . . This is a victory for American consumers, and we are proud to have stood by their side in this important fight over the fundamental rights of consumer choice and control.”

A Fox spokesperson predictably took a different tack:

“We are disappointed in the decision but recognize that preliminary injunctions are rarely overturned on appeal . . . That said, the ruling was based on a factual record from more than a year ago. Now that we have gathered more evidence, we are confident that we will ultimately prevail on all of our claims.

    If someone pays for the service, then they should be able to skip ads if they want to.

    If I couldn’t skip them I would mute the tv until they were over. I guess they would sue tv manufacturers to take the mute button off the remote.

    I actually don’t like skipping commercials. I had a SageTV DVR at one point and set it up so that I could skip commercials. The problem was that since I didn’t see the commercials, I frequently didn’t find out about new shows and such until after they were already a few weeks into the run.

    Now I’m using a U-verse DVR which only allows me to fast forward. I can still see bits and pieces of the commercials as it goes. It probably takes about 10-15 seconds to FF through a commercial break and if I see something interesting, I can back up to watch an ad for a new TV show or a movie trailer.

    What’s the difference if I pause the TV and then fast forward in 30 sec intervals to skip the commercials?

    They are nervous that if we don’t watch the commercials they won’t make any money and be forced to go off the air or charge us more money lol

    Ya know, when cable first came out years ago (when I was a child) there were NO commercials, that’s why you paid for the service. Then slowly and steadily they started adding commercials and you STILL paid for the service (even more by then!), so they were making money from the customer AND from the advertisers! That’s why pay tv is such a rip-off!!!!!
