Walmart and Netflix were hit with a class action lawsuit early this year, and reports came out in late summer that Walmart was planning to settle, while Netflix planned to continue fighting. Emails to people covered by the Walmart settlement began going out today, and a final hearing on the settlement will take place in March.

5 million payment, some of which will also go to pay legal fees. Walmart has agreed to settle without acknowledging any wrongdoing in the accusations of collusion with Netflix that have been leveled at both companies.

The settlement will be paid in cash or Walmart gift cards, but may not amount to much per person if most of those who are eligible accept the payment. Eligible recipients have until February 14 to opt out.

    Yes! but *only* with the Walmart settlement. Anyone who was a subscriber between May 19, 2005 to September 2, 2011, who retained the same e-mail address from their subscription, received same.

    By *not* responding to the Netflix litigation, subscribers will remain as part of the class action suit.

    so, i read all the legal stuff, but i still have a question. Objector’s have to file in writing within 90 days, but do they still get to claim any compesation?
    I’m all for smart buisness, and I believe Netflicks and Walmart did great. This class-action is retarded, but if walmart’s giving handouts, i’ll accept it.
    Who wouldn’t in this economy? And that’s part of the problem, i realize that, but it’s the real world, we have families to support. Too many suits like this drive up costs and hurts the consumer. Truly the working class is mostly affected because we can’t afford the high end retailers and green grocers, whatever they’re calling themselves now.
    I object to the suit in theory, but need help financialy. Sorry fellow Americans, it stinks to high hell, and I hope someone can fix it (not lawyers).

    Actually Nate those asking people to boycott the settlement don’t understand the way the law works. I agree the lawsuit is stupid and frivolous however we have no say in the matter. Wal-Mart and the lawyers appointed by the judge who made this a class suit decided on an amount. The amount will be the same no matter how many people sign up, so there’s really no incentive not to.

    As far as Netflix is involved my understanding is that by accepting the Wal-Mart card you are excusing Wal-Mart from the case. Netflix is going to trial and your rights regarding that should not be affected. By not accepting the gift card the only rights you maintain are the possible rights to sue Wal-Mart personally. Good luck with that however as class suits usually take precedence. You are entitled to you day in court however so the option is left open.

    In short, sign up for the gift card with no guilt as you aren’t changing the outcome of the case nor the amount WM is paying out.

    As a side note Wal-Mart most likely settled because they know that gift cards drive customers into the store. The git cards will happen to hit at tax time also which is critical for their first quarter revenue. Don’t feel bad for Wal-Mart. They planned this strategically. They’ll make much more on this settlement than they pay out, I promise you that.

    Two things I forgot.

    1- it’s rumored that Wal-Mart is settling mostly to get names and addresses of Netflix customers for direct marketing purposes. They could also in theory offer Vudu credit in lieu of or in addition to a full store card.

    2- someone needs to create an objection letter and gather the proper addresses to send it to. The lawyers are asking for too large a chunk of the money. You should be able to file a claim and object to the settlement terms at the same time.

    This reminds me of the the class action lawsuit Customers With Late Fees Vs. Blockbuster. Blockbuster had to pay out a settlement but was allowed to do so with coupons. So people who have trouble returning movies on time were given coupons to rent movies and to top it off they couldn’t rent until they paid their outstanding late fees. So who really won that lawsuit?

      You KNOW who won – the lawyers. They got CASH – not stupid coupons. WE ARE ALL SHEEP! ! ! ! ! ! ! ! AND the FIX was in from the start. I just got a settlement check for less than $20 from a years-old class action against overcharging CC customers for conversion charges – only AFTER I refused their first check to me for @$3 bucks! Speaks volumes – if you don’t think the attorneys and judges are just as dirty as WM, start getting fitted for a straight jacket.

    Oh, and another consumer-screwing. Have you seen this yet – – – instead of a rebate you now get a CC for the amount of the rebate. So you NEVER get CASH! You MUST spend it (consume, consume, consume.) Visa/MC then get their cut, the corp gets it DISCOUNT for using them, etc., etc., etc. Just like Bernie MadeOffWithTheMoney Madoff – everyone EXCEPT “the people” get to keep their money – we, “the people” are always going to get the **it-end of the stick!     From what I read if you have to opt in on the Wal-Mart side not opt out. And if you opt in you are automatically opting out of the case with Netflix. I received the email. I decided to just opt in with the Wal-Mart one. I only doing it cause I figure a gift card is a gift card. I stopped my Netflix account once they signed all them 28 day delays with all the movie studios. It was bad enough I wasn’t getting the new releases before they signed all those 28 day deals.
