This declaration comes as the SEC is considering a lawsuit against Hastings for comments he made on Facebook last year.

In a recent interview with Bloomberg, Hastings defended the post that got him in trouble: a boast about Netflix reaching the billion-hour streaming mark the previous month. The SEC hit Hastings with a warning about an error in disclosure protocol.

Hastings said the following about the incident:

“I wasn’t setting out to set an example . . . I was sharing something to these 200,000 people. I’m not going to back down and say it’s inappropriate.
